Terms of Service

1. General

Apifon S.A. is a Greek messaging automation company. These terms govern all use of wemail services and are governed by the laws of Greece as well as EU legislation. We reserve the right to modify these terms with advance notification to registered users.

2. Your Account

You must provide true, current, complete and accurate information during registration. You may create or access your account using an email and password or through a third-party authentication provider such as "Sign in with Google" or "Sign in with Microsoft"; in that case you authorize us to receive basic profile information from that provider as described in our Privacy Policy. Account security is your responsibility. We accept no responsibility or liability for unauthorized access resulting from your failure to safeguard your credentials.

3. Payment

Payment occurs upfront via monthly subscription, pre-paid balance, or credits. Bank transfers under 500 euros are not permitted. Rates may be modified with written notice. All prices are exclusive of applicable taxes unless otherwise stated.

4. Service Level

Services are provided "as is" and "as available" without warranties. We do not guarantee uninterrupted or error-free operations. We strive for 99.9% uptime on all critical services.

5. Compliance Obligations

You must follow applicable laws and avoid transmitting illegal, harmful, or spam content. You bear full responsibility for message content and sender identification. Anti-spam policies are strictly enforced.

6. Data Protection

Under GDPR, Apifon acts as a data controller for user account data and processor for end-user data. Processors must implement appropriate technical and organizational measures for security. Our standard Data Processing Agreement (DPA) is incorporated into your service agreement by reference and applies automatically from the moment you sign up; a countersigned copy is available upon request. Custom DPA terms may be available on eligible plans.

7. Use of Data

End Users' Data remains your property, disclosed only when materially required or legally mandated. We do not use your customer data for our own marketing purposes.

8. Confidentiality

Both parties protect confidential information from unauthorized disclosure. Passwords are hashed — we do not have access to them in plain text.

9. Intellectual Property

All intellectual property rights in the platform remain exclusively with Apifon. Your use of the service does not grant you any rights, intellectual property rights, or licenses beyond what is necessary to use the service.

10. Limitations of Liability

Apifon excludes liability for transmission delays, unauthorized use, and non-compliant communications. We only cover proven direct damages, not indirect or consequential losses. Total liability is limited to fees paid in the 12 months preceding the claim.

11. Termination

Apifon may suspend or terminate access for non-compliance, service misuse, bankruptcy, or twelve (12) months or more of inactivity. No refunds apply for prepaid but unused credits upon termination for cause.

12. Dispute Resolution

Greek law governs these terms. Parties should attempt amicable resolution before litigation. The courts of the city of Thessaloniki in Greece shall have exclusive jurisdiction.
